Objectives:

This course examines the related topics of Civil Liability and Use of Force by peace officers. The course is divided into two four-hour segments as follows:
Force Segment – The “force” segment of this class focuses on 720 ILCS 5/7-5. Peace officers use of force in making arrest, and other statutes and case law relating to use of force in the contexts of self-defense, apprehending persons and making entries. The exercise of an officer’s authority to use force has great potential for generating civil liability. All officers and supervisors should be aware of the governing statutes and case law in this vital area.
Civil Liability Segment – This segment reviews civil liability issues affecting Illinois officers. Common liability producing behavior, the liability of individual officers, supervisory personnel, and governmental entities which employ them, are examined. Immunity and indemnity in suits brought in Illinois and federal courts are examined. Both cases and statutes relating to civil liability will be explored in this course. Included in the Civil Liability monograph, but not discussed in class, is civil liability of state officers (e.g. State Police).
