DUI Legal & Investigative Considerations & Illinois Vehicle Code Update

Objectives: The morning session will be a very practically oriented "how to" course and will examine recent and long standing statutes and case law that controls an officers handling of DUI and related cases from the moment of initial observation of a suspect through the completion of the investigation. Also examined will be Involuntary Manslaughter and Reckless Homicide.

The afternoon session will be dedicated to review and updates of the Illinois Vehicle Code.

Statutes and Case Law that will be examined include:
• Driving under the influence
• Implied consent
• Suspension hearings
• Chemical testing in injury and death accidents
• Compulsory testing in certain injury or death accidents
• Zero tolerance
• Illegal transportation of alcohol

Among problematic questions to be considered will be:
• Conducting Field Sobriety Tests
• Manner of giving Implied Consent Warnings
• Warning the uncooperative/combative arrestee
• Right to counsel
• Miranda warnings
